To investigate how bereaved families felt about the explanation received before and after forensic autopsies, the authors conducted a cross-sectional survey of the bereaved families whose next of kin underwent a forensic autopsy at the two Departments of Forensic Medicine and a few bereaved families of crime victims. Of 403 questionnaires sent, 126 families responded. Among 81.5% of the respondents who received an explanation from policemen before the autopsy, 78.8% felt that the quality of the explanation was poor or improper. (...) In Japan, the law has restricted disclosure of information from a forensic autopsy. Despite legal restrictions, 82% wanted to hear from the person who conducted the autopsy. However, police explained the results of autopsy to 65.2% of respondents. Among the families whose frustration and anger increased after autopsy, 86.4% had not been satisfied with the explanation before the autopsy. Additionally, 57.7% had not been informed on the autopsy findings at the time of the questionnaire when more than 2 years had passed after the autopsy. These results reminded us of the importance of an explanation before and shortly after a forensic autopsy for a better understanding and acceptance by bereaved families. (shrink)

Unpublished counts of larceny arrests and census data for five of the largest cities in the United States are used to examine the contribution of white and nonwhite men and women in specific age groups to increases in larceny arrests from 1960 to 1980. The results suggest that nonwhite women and white men now have similar larceny arrest rates and that 77 percent of the total increase in the arrest of women for larceny from 1960 to 1980 was the result (...) of increased arrests of nonwhite women. Although 18 percent of this increase can be explained by increased numbers of nonwhite women in specific age groups in the population, the worsening economic situation of young black women in older U.S. central cities is suggested as the most plausible explanation for these trends. Implications of the findings for other theories of women's criminality are examined. (shrink)

Blood service organizations employ various ways to ensure transfusion blood safety, including the testing of all donations for transfusion-transmissible infections (TTI) and the exclusion of donors who are at increased risk of a recent infection. As some TTIs are more common among men who have sex with men (MSM), many jurisdictions (temporarily) defer the donation of blood by sexually active MSM. This boils down to a categorical exclusion of a large group solely on the basis of their sexual orientation, which (...) is seen as unduly discriminatory and stigmatizing. Blood service organizations in the U.K. and the Netherlands have recently changed their deferral policies for MSM. The problem of the MSM deferral involves a conflict between fundamental rights: the right of MSM to equal treatment and the right to health of the recipients of blood and blood products. We distinguish and discuss three broad alternative options to the current categorical deferral of MSM donations: (1) completely abandoning donor selection on the basis of sexual behavior, (2) individual risk assessment of the sexual activities of each potential donor, and (3) individual risk assessment of the sexual activities of MSM only. The new U.K. policy falls within the second category, and the new Dutch policy is in the third category. We argue that each approach comes with moral costs but that the most reasonable option is different from the policies of both the U.K. and the Netherlands. (shrink)

Blood service organizations employ various ways to ensure transfusion blood safety, including the testing of all donations for transfusion-transmissible infections (TTI) and the exclusion of donors who are at increased risk of a recent infection. As some TTIs are more common among men who have sex with men (MSM), many jurisdictions (temporarily) defer the donation of blood by sexually active MSM. This boils down to a categorical exclusion of a large group solely on the basis of their sexual orientation, which (...) is seen as unduly discriminatory and stigmatizing. Blood service organizations in the U.K. and the Netherlands have recently changed their deferral policies for MSM. The problem of the MSM deferral involves a conflict between fundamental rights: the right of MSM to equal treatment and the right to health of the recipients of blood and blood products. We distinguish and discuss three broad alternative options to the current categorical deferral of MSM donations: (1) completely abandoning donor selection on the basis of sexual behavior, (2) individual risk assessment of the sexual activities of each potential donor, and (3) individual risk assessment of the sexual activities of MSM only. The new U.K. policy falls within the second category, and the new Dutch policy is in the third category. We argue that each approach comes with moral costs but that the most reasonable option is different from the policies of both the U.K. and the Netherlands. (shrink)

To study Judicial determinants of the ordered obstetrical and fertility interventions. Nature, corresponding laws, decisions upon the 37 expounded holdings at the Probate, Trial, District, Appellate, and Supreme Courts are studied in 92 published materials identified through the ACOG, RCOG, SOCG portals, and Legal Scholarship Repository. Hearings are held in the US (83.8 %), Canada (10.8 %) and U.K (5.4 %). Of all the hearings reviewed, 27 % concern mentally impaired, 37.8 %-maternal incompetence, and 21.6 % cases are of criminal (...) nature. The Judicial determinants vary from country to country. In Canada, the ordered medical interventions are effected by the child protection legislation, whereas in the US, by court orders. In majority of cases, orders are obtained by dismissing the patriae petitions for involuntary sterilizations of mentally impaired sui juris adults (57 %); coerced obstetrical interventions (33.3 %), fetal custody (50 %); enforcement of surrogacy contracts (62.5 %) in favor of the Common Humanity Benefit clause; and recognizing the rights to inherit in posthumously conceived children (80 %) pursuant to the Social Security Act, Law of obviousness, Law of inherent anticipation, and Intestacy statute. Current study prioritizes two questions: (1) whether it is justified to override the wishes of a competent patient purportedly in her best interests; and (2) whether the patient’s autonomy and competence is an absolute concept. With the law unsettled as to a woman’s right to assent a treatment and contradict her fetus, parties concerned with fetal rights should consider exercising of screening tools on maternal judgmental fitness jointly developed by medical and legal practitioners. Further, given the advances in gamete conservations, states consider enacting legislation in order to safeguard the orderly administration of estates disrupted by claims from posthumously conceived children. A balance must be struck between the child’s right to inherit, the state’s interest, as well as the interests of prior born children. (shrink)

Yoshida considers two broad understandings of how social scientists can and should “describe and explain other cultures or their aspects under concepts of rationality” . In the one corner is a family of approaches that Yoshida finds deeply flawed: cultural interpretivist approaches. Five authors representative of this family are given fine chapter length examinations: Winch, Taylor, Geertz, Sahlins, and Obeyesekere. In the other corner is Yoshida’s favored approach: critical rationalism. This approach is associated with the intellectual descendants (...) of Karl Popper—notably Jarvie and Agassi. It is presented in outline and treated as the clear winner. By virtue of not having the defects that are diagnosed in the interpretivist approaches, critical rationalism is presented as the fitting approach in the social sciences. Our tendency is not to read Romantic poetry as alluding to the texts it reminds us of. We think of the Augustans as the author of what Reuben Brower calls "the poetry of allusion."5 We envision Romantic poets carrying on their work in reaction to these Augustans and in mysterious awe, whether fearful or admiring, of most other poets—sometimes even of each other. No self-respecting Romantic, it is usually assumed, will deliberately send his reader elsewhere for a meaning to complement (...) the effect of his own words. If a reader's mind wanders to an earlier poem, that is not the Romantic poet's fault but a matter of accident or perhaps of cruel destiny. The Romantic wants to keep the poem an intimate affair—just the two of us—and does what he can to keep his reader's attention on himself.[…]What follows is an effort to test the applicability of Wasserman's Augustan hypothesis to the poetic mode of high Romanticism. This effort should not be taken to imply either that the Romantics simply continue in the allusive mode of the Augustans or that the assumptions that lead Bloom and others to read Romantic poetry as they do are utterly mistaken. I will in fact be arguing quite otherwise. Nor must there be any confusion about Wasserman's conception of the Augustan mode. Some of the language of his summary, for example where he speaks of "the rich interplay between the author's text and the full contexts it allusively arouses," might lead one to liken his work to the criticism now associated with the notion of "intertextuality." For the practitioners of this criticism, as Jonathan Culler explains, "to read is to place a work in a discursive space, relating it to other texts and to other codes of that space, and writing is a similar activity."8 Writing and reading a poem are in this account both acts of "intertextual location," if you will, but the reader of the poem need not concern himself with the aims and circumstances of its writer's "similar activity." The decisive difference between this view and the one Wasserman offers for the Augustans is that Wasserman's is intentionalist and historicist. This shows plainly in his exegetical commentary on the Rape, where his characteristic claim follows the formula: "Pope [expects, invites, prods, wants] his reader to [discover, exercise his wit on, recognize, see] X in his allusion to such-and-such a text." And to support his claim he repeatedly brings his historicist scholarship to bear on questions about "the kind of ready knowledge Pope demands of his reader" and what "facts [were] known to any serious reader" of the time.95. The editor of this text has brought together fifteen selections representing some of the major contributions philosophers have made to the study of the aims of education. This anthology is organized into three parts: classical, modern and analytic philosophies of education. Each selection is preceded by the editor’s one page introduction, which unfortunately is far too short to prepare the student to deal technically with the material. In the part devoted to classical writings on education, texts from Plato and Aristotle (...) are offered with no regard to the cultural setting, while the excerpts from Locke, Rousseau and Kant seem to be presented principally with a concern for moral education. The five modern selections are far more interesting, particularly those from Dewey and Russell. The material from Maritain and Whitehead is preponderantly practical, though Sidney Hook’s defense of Dewey will afford the student an appreciation of careful argument. By far the most engaging part of the book is the last, comprising significant selections from Scheffler, Ryle and Jane Roland Martin. A portion of R. S. Peters’ Authority, Responsibility and Education is reprinted, but surprisingly enough, Peters’ far better book, Ethics and Education, is neglected. Cahn presents a short essay of his own, "Is There an Analytic Philosophy of Education?" which he probably would have modified had he been acquainted with Peters’ recent work. The likely use of this anthology is the teacher education course commonly referred to coincidentally by the same title. It is to Cahn’s credit that he has attempted to expose the education student to genuine philosophy, yet this anthology presents a mere mass of material without an effort at providing direction, structure or synthesis. The serious philosophical work of systematically analyzing education, culture, self and meaning still remains as much a task as it did before, though now thanks to Cahn some of the working materials for such an endeavor have been made more available.—J. A tension runs through the lucidly militant work of Alain Badiou. It takes various shapes, such as the tension between the rigorous ontology of mathematics and the structures of narrative, or between fiction and argument, image and formula, poem and matheme, or Anglo-American analytic rationalism and continental lyricism. However, the shape of that tension that interests me most is between the triumphant banishing of theology via mathematics and its perpetual recurrence in his thought. For all Badiou’s efforts to dismiss theology (...) as the philosophy of the ‘One’, for all his efforts to read Pascal, Kierkegaard or Paul as exemplars of the ‘event’ without buying into the belief system they purvey, for all his dismissals of the pious myth or fabulous core of Christianity, it seems as though he cannot avoid theology. The question then is whether this philosopher who is ‘rarely suspected of harbouring Christian zeal’ may actually provide an insight or two into theology. The texts on which I base my reading are Being an Event, the short book on Paul, Logiques des Mondes, especially the section on Kierkegaard, and parts of the disparate collection, Theoretical Writings. A rather formidable collection, to say the least. In what follows I begin by considering the absolute blockage of theology in Badiou’s philosophy, specifically through his banishment of the One. And yet, despite his best efforts to seal his system against theology, it has an uncanny knack of returning. I am particularly interested in the way theology has a ghostly presence in what appears for all the world like a fifth ‘procedure of truth’ (alongside the four pillars of art, science, politics and love), in his enthusiastic affirmations of Pascal and Kierkegaard, and the play between fable and truth in his engagement with the apostle Paul. Considering the organization’s ethical context as a framework to investigate workplace phenomena, this field study of military reserve personnel examines the relationships among perceptions of psychosocial group variables, such as cohesiveness, helping behavior and peer leadership, employee job attitudes, and the likelihood of individuals’ withholding on-the-job effort, a form of organizational misbehavior. Hypotheses were tested with a sample of 290 individuals using structural equation modeling, and support for negative relationships between perceptions of positive group context and withholding effort by individual (...) employees was found. In addition, individual effort-performance expectancy and individual job satisfaction were negatively related to withholding effort. The findings provide evidence that individual perceptions of positive group context play a key role in the presence of misbehavior at work. The results indicate that positive group context might be an important element of ethical climate that should be managed to temper occurrence of such adverse work behavior. (shrink)

This article reassesses a rarely noted aspect of the Russian Revolution: the long interaction between Lenin and Anatoly Lunacharsky, the ‘God-builder’. It traces the way Lunacharsky first outlined the God-building position in his Religion and Socialism, a text virtually lost to scholarship and interpretations of the Russian revolution. It explores Lenin's initial condemnation, for political but above all theoretical reasons, only to find him reassessing his whole argument six years later in light of his re-engagement with Hegel in 1914. Seeing (...) that his earlier condemnation no longer held, Lenin's response to Lunacharsky's God-building undergoes a noticeable shift. He now realizes that marginal forms of interaction with religion may sit well with, if not lead to, communism. An examination of Lunacharsky's own perseverance with God-building after he was appointed Commissar for Enlightenment in the new Soviet state, and of Lenin's awareness and tacit allowance for such expressions, indicate a more complex and ambivalent approach to religion on Lenin's part. Even though The Medium Place is overshadowed by the dramatic events that unfold in the fake Good Place neighborhood, it is more significant to The Good Place. The Medium Place is described as an individually tailored “eternal mediocrity,” a place of neutrality and compromise. One of the most prominent contemporary cultural theorists, Homi K. Bhabha, calls this space of becoming, where contradictions and differences are explored rather than resolved, a “Third Space”. Bhabha claims that despite its importance, being “in‐between” is (...) usually “unrepresentable,” and Roland Barthes too refers to his idea of the “third possibility” as having “no place” of its own. But the writers of The Good Place have proved them wrong—they have found a way to represent this middle “in‐between” space it as a geographical neighborhood. The morality of The Medium Place is the most human and realistic of all The Good Place neighborhoods. (shrink)

The central role of human dignity in ethics and law stands in striking contrast to the disagreement regarding the meaning and normative content of this concept. Each competing theory of human dignity also has serious problems. Against the background of this situation, the meaning-oriented theory of human dignity suggests a new understanding that can integrate a number of conceptions of human dignity and resolve their theoretical problems. According to this new theory, respect for human dignity consists in respect for human (...) beings as beings that confer meaning and need meaning. The integrative and problem-solving power of this new approach is demonstrated here by examining two lines of theory: on the one hand, the Kantian tradition of an autonomy-oriented understanding of human dignity, and on the other hand, a theory that focuses on individual identity and protection against humiliation. I present a game-theoretical multi-agent system to simulate the evolutionary process responsible for the pragmatic phenomenon division of pragmatic labour (DOPL), a linguistic convention emerging from evolutionary forces. Each agent is positioned on a toroid lattice and communicates via signaling games , where the choice of an interlocutor depends on the Manhattan distance between them. In this framework I compare two learning dynamics: reinforcement learning (RL) and belief learning (BL). An agent’s experiences from previous plays influence his communication behaviour, and (...) RL agents act in a non-rational way whereas BL agents display a small degree of rationality by using best response dynamics . The complete system simulates an evolutionary process of communication strategies, which agents can learn in a structured spatial society. The significant questions are: what circumstances could lead to an evolutionary process that doesn’t result in the expected DOPL convention; and to what extent is interlocutor rationality necessary for the emergence of a society-wide convention à la DOPL?
